Things to consider

Our Frequently Asked Questions (FAQs) page answers questions that our clients face when trying to decide the best course of action for themselves and their children. We’re committed to helping you with issues that are most important to you.

Why should I choose OKDivorceNow as my document preparer?

Most legal document providers are either not attorneys (or even paralegals) or are not actually in Oklahoma.

OKDivorceNow has a team that includes attorneys with decades of combined experience in cases just like yours in the state of Oklahoma.

Family law documents are legal documents with very real long-term effects.

Just because you agree and do not want to fight in court does NOT mean you should settle for less than top-notch legal documents and guidance.

What is an uncontested divorce?

An uncontested divorce is a divorce where both parties agree to the terms of the divorce in advance and do not need to rely on a third party, such as a judge, to make the decisions about your property, debt, custody, fault, alimony, visitation, child support, etc.

Do you handle same sex divorces?

Absolutely. If you both agree on the terms, we can help.

Can I get an uncontested divorce if I have children?

Yes. You can get an uncontested divorce with children as long as the parties agree to the terms of custody, visitation, and support.

What if we have joint property and bills?

All of this can be dealt with legally through the uncontested divorce as long as you agree.

How much does OKDivorceNow charge?

Divorce - NO minor children - $250
Divorce - with minor children - $300
Custody and Child Support (no divorce) - $250

You will pay your filing fee directly to the court later, average: $150- $250.

Are there cheaper document providers I could choose?

It's true that OKDivorceNow is not the cheapest document provider you can find; however, as with so many things in life, when it comes to legal documents, YOU GET WHAT YOU PAY FOR!

Do NOT settle for the rock-bottom cheapest document preparer.  OKDivorceNow has something the other services do not: an experienced team that includes licensed Oklahoma lawyers with over a decade of experience in family law cases like yours.  Don't settle for someone with no little to no legal experience who has never stepped foot inside an Oklahoma family law courtroom. Your money is well-spent knowing your uncontested documents are the very best your money can buy.

Where do we get divorced?

One party must have lived in the State of Oklahoma for at least 6 months prior to filing for divorce, custody, or paternity.

Also it is filed in the County of residence for at least 30 consecutive days prior to filing.

How long will it take to get my documents?

You will receive a client packet instantly once you have hired us and can begin working on it right away (no printer required).

In most cases, all documents are provided within 5 business days from the date we receive your completed client packet from you.

Do we have to agree on the terms of the divorce?

Yes. If both parties do not agree on the terms of the divorce or child custody and visitation issues, this service is not appropriate and each party should seek help from an individual attorney, or come back to us if and when you are in agreement.

How long will my divorce take?

If there are no children of the marriage, there is a 10-day waiting period.  (Dist. Court Rule 8).

If there are children of the marriage, there is a 90-day waiting period.  (Title 43 Section 107.1).

When can I get married again after my divorce is final?

In Oklahoma, one cannot marry anyone other than their previous spouse for at least 6 months from the date their divorce is final. (Title 43 Section 123).

Can we agree to a child support amount that is different from the amount in the child support calculation?

Generally, a Court will order the amount of child support designated in the child support calculation.

However, the court can approve a different amount for good cause shown (such as one spouse is continuing to pay the other spouse’s mortgage, car payment or significant child expenses such as private school, etc.).

This will ultimately be subject to the court’s approval when your final Decree is presented.

Once I get my documents, how do I know what to do next?

As part of your package, you will receive very detailed guidance and step-by-step instructions tailored to your case, so you will be confident you are handling things the right way.

Will I have to go to court?

For a divorce, you will need to see a Judge once when you present your final Decree.

Don’t worry!  It isn’t scary, and we will have you organized and well-prepared in advance so it’s easy.

Chances are, you will be in and out quickly and many never even have to enter the courtroom.

Does it matter who is the Petitioner or Plaintiff in an uncontested case?

Not really. Generally, the party listed as the Petitioner or Plaintiff will present the agreed Decree to the court; however, this is not mandatory as long as the party who does not attend the presentation has signed the waiver and the waiver has been filed.

If I pay for your services, are you my attorney?

No. OKDivorceNow cannot and will not represent either party or provide legal advice in your case.

If your divorce is uncontested, what you really need is the correct information and guidance, which we absolutely do provide.

What if we file, but later do not agree anymore?

At that point, you will want to evaluate whether you will need an attorney to represent you or will represent yourself in a contested case.

If the other party hires an attorney, you should seriously consider hiring your own attorney.

We may be able to make a recommendation to you, depending on your location.

I think our case is probably going to be uncontested. What do I do next?

Hire us. Many times, the earlier you come to an agreement, the less likely one of the parties is to hire an attorney and start fighting.

In fact, the client packet we provide to you includes a document to help you understand what issues are involved in your particular case and what kind of agreement can be made.

Some clients complete the document with the other party so both know all issues are covered, but this isn’t required.

What if we change our minds after we pay you and don’t want to go through with filing?

That’s ok! You don’t have to have the documents filed unless and until you are ready!

However, because we start work immediately, refunds are not issued once your file is opened.
